Lindsay Lohan is trapped in France after conveniently losing her passport ahead of a mandatory court date that could have kept her out of jail.
The troubled actress was ordered to appear before a California judge on May 20 for issues relating to her probation on two DUI charges in 2007.
If she doesn't front and is found to have violated her probation or failed to have abided by a court order, deputy district attorney Danette Meyers said she could face 180 days in jail.
But Lindsay, who escaped to the Cannes Film Festival for a few days, claims her passport was stolen while in France and that she can't get a new one in time.
Her father Michael Lohan has called it "another lie" and is planning to front up at court and plead the judge to sentence her to rehab.
But mum Dina claims the lost passport is "not a planned scheme".
"She has filled out an application for a new passport. We've filed the necessary police reports. We're actively trying to get her home," she said.
"This is a very serious situation and it's been very difficult. We're all taking this very seriously but it's important not to let it snowball into something it's not."
