An attempt by The North Face clothing company to shut down a teen's parody label The South Butt has failed.
The North Face wanted unspecified damages and the parody clothing line shut down when it sued 19-year-old The South Butt owner Jimmy Winkelmann last December.
But last week the firm entered into a secret settlement with Jimmy, who is still selling his range of jackets, shirts and hoodies.
The college student started the line two years ago to make a quick buck. He developed a range of clothes marketed with the line "Never Stop Relaxing", which is a take on The North Face tag "Never Stop Exploring".
The North Face complained the label infringed its trademarks.
The South Butt's attorney Albert Watkins countered: "The consuming public is well aware of the difference between a face and a butt."
