Usher cries in court custody battle

At an Atlanta court on May 21, Usher broke down in tears after Foster's attorney accused him of caring more about partying than his two children - using photos of the singer having late night fun in Europe as evidence.

The singer, whose album, Looking 4 Myself, is soon to be released, was also questioned about his drug use and admitted to smoking marijuana. Usher's lawyer objected when he was questioned about ecstasy.

Foster previously alleged that Usher used drugs in front of their children, but the "Scream" crooner denied these claims. The two were married for two years, from 2007 to 2009.

The 33-year-old testified that Foster spit at him and tried to fight his girlfriend during a visit, but that he did not press charges because "I didn't want the boys to know that their father put their mother in jail."

The trial is ongoing.
